Mr X complained that Llansteffan & Llanybri Community Council (“the Community Council”) is failing in its duty to uphold the law by not using the Statutory Power at its disposal to protect the land they registered as a Village Green. Mr X also complained that the Community Council were delayed in dealing with his complaint and failed to follow the procedures and policies laid down in its Financial Regulations and Standing orders.
The Ombudsman contacted the Community Council and it agreed to undertake the following:
a) Provide Mr X with its decision, in writing, that it is not making a decision on the Village Green until it has received communication from the County Council about the legal advice it has obtained. The Community Council also agreed to regularly contact the County Council, on at least a monthly basis, to follow up on this matter and obtain updates.
b) The Community Council will provide Mr X with an update, every month, on the progress in obtaining the relevant communication from the County Council.
c) The Community Council will, following receipt of the communication from the County Council, make its decision and communicate in writing this to Mr X. This will be done within 2 months of its receipt.
