Miss A complained that Social Care Wales (“the Body”)applied the wrong test in its decision to close her fitness to practise complaint about a registered Social Worker.
The Ombudsman found that the Body relied on inaccurate information, which was not supported by policy, in its decision to close Miss A’s complaint. The Body also failed to address Miss A’s specific concerns and how it considered them to be matters of the court as opposed to fitness to practice concerns. The Ombudsman considered that the Body failed to provide Miss A with an accurate and specific fitness to practise complaint response.
The Ombudsman sought and gained the Body’s agreement to provide Miss A with a complaint response which sets out how it considers her specific concerns to be related.
