Mr A complained that Swansea Council had failed to take enforcement action in respect of works carried out next to his property. Mr A was unhappy that he was not receiving further updates, despite the Council telling him that matters were being progressed with the developers of the works.
The Ombudsman noted that the Council was in contact with the developers to agree proposals for the completion of improvement works against the original works undertaken. However, the Ombudsman was concerned that the works had originally been completed in 2020 and so the matter had been ongoing for some time. The Ombudsman cannot force the Council to take enforcement action against the developers, but decided that Mr A should receive updates regarding the progression of the works, to ensure that they are completed in a timely manner. The Ombudsman decided to settle the complaint without an investigation.
The Ombudsman sought and gained the Council’s agreement to, within 2 weeks, provide Mr A with a detailed update and to inform him of when the next update can be expected.
