Mrs X complained that the Council had failed to respond to her complaint regarding the maintenance of a cherry tree on Council property which she alleged was causing a health and safety risk and damage to her garden.
The Ombudsman decided that the Council should provide Mrs X with a written response (by 27 April) to address her complaint, and it should also offer Mrs X an apology for the delay in its response.
The Ombudsman considered this to be an appropriate resolution to the complaint instead of conducting an investigation.
