Mrs X complained about the care and treatment her late father received at Cardiff and Vale University Health Board.
The Ombudsman found that the Health Board had identified a qualifying liability, however, it had failed to advise Mrs X of her right to legal advice under the financial redress provision of the ‘Putting Things Right’ procedure, which the Ombudsman said was a disadvantage to Mrs X. The Ombudsman decided to settle the complaint without an investigation.
The Ombudsman sought and gained the Health Board’s agreement to, within 1 week, write to Mrs X clearly outlining the next steps in the process and informing her of her right to legal advice.
